Al-Badawi’s “Rearrest”

Many news sources out their have al Badawi being “rearrested.” This is wrong on two accounts – first, and most egregiously, the statements from the Yemeni government never indicated that he was rearrested…they simply sought to redefine his current state of custody. Secondly, those sources obviously relied upon the Yemeni government’s English translation of their statement which says that al Badawi is “under arrest.” Technically, if you look at the Arabic versions of the article they all use the word “محتجز” which is more accurately translated as “detained” (but can also mean anything from secluded to sequestered to isolated). the meaning of “Mohtajz” CAN INCLUDE HOUSE ARREST. If they wanted to say “arrested” as in being in prison they would have used “عتقل” which cannot be used for house arrest, and is much more clear.   

To their credit, Reuters and the APtranslated the word as “detained” – although they left the exact meaning uncertain and therefor gave the perception that al Badawi’s status has changed. Also, for the record, SABA did have the statement.

almotamar.net – An interior ministry official source on Sunday stated that Jamal al-Badawi, the second person accused in the case of blasting the American Destroyer SS Cole in 2000 offshore Aden Port and who surrendered to security authorities is currently under arrest and subject to interrogation by concerned authorities.

A security source had on 16 October announced that Jamal al-Badawi, on of al-Qaeda operative and one of the 23 escapees from the political security prison had turned himself in to security authorities.

The appeals section in Sana’a has previously commuted sentence of the criminal court from death to 15 years imprisonment.
